Employment Contracts & Negotiations

Termination & Redundancy Contracts
If you are employed under a contract of employment you are entitled to receive notice if your services are being terminated and the notice period must be stated in the contract.
Even if you are not employed under contract, notice must be given. The Employment (Termination and Redundancy Payments) Act states as follows:

3.-(1) The notice required to be given by an employer to terminate the contract of employment of empIoyees who has been continuously employed for four weeks or more shall be-
(a) not less than two weeks’ notice if his period of continuous employment is less than five years;
(b) not less than four weeks’ notice if his period of continuous employment is five years or more but less (c) not less than six weeks’ notice if his period of continuous employment is ten years or more but less than fifteen years;
(d) not less than eight weeks’ notice if his period of continuous employment is fifteen years or more but less than twenty years;
(e) not less than twelve weeks’ notice if his period of continuous employment is twenty years or more, than ten years; and shall be in writing unless it is given in the presence of a credible witness.
(2) An employee who has been continuously employed for four weeks or more shall give not less than two weeks’ notice to terminate his contract of employment.
(3) The provisions of subsections (1) and (2) shall to prevent either party to a contract of employment from waiving his right to notice at the time of termination, or from accepting a payment in lieu of notice, or from giving or accepting notice of longer duration than that of the relevant notice specified in those subsections.
